PARTICIPANT/VOLUNTEER AGREEMENT
I acknowledge that mountain biking or trail rides is an inherently dangerous sport and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, dangers of collisions, the actions, or omissions, including negligence, of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to athletes but are also present for volunteers. I hereby assume all the risks of participating and/or volunteering in this event, whether known or unknown. I realize that liability may arise from negligence or carelessness on the part of the persons or entities being released from dangerous or defective equipment or property owned, maintained, or controlled by them or because of their possible liability without fault. I agree it is my sole responsibility to be familiar with the event course and agenda, the rules of the event, and any special regulations for the event and agree to comply with all such rules and regulations. I understand and agree that situations may arise during the event which may be beyond the control of The City of Fort Dodge, as well as their directors, officers, volunteers, representatives, and agents, participating non-profit organizations, Fort Dodge Bike Club, the event holders, event sponsors, event directors, event volunteers, and event officials (the “Releasees”), and I must continually ride and otherwise participate so as to neither endanger myself or others. I accept responsibility for the condition and adequacy of my equipment, any equipment provided for my use, and my conduct in connection with this event. I will wear a helmet that can protect against serious head injury, and assume all responsibility and liability for the selection of such helmet and other equipment. I hereby agree for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: A) I waive, and release and discharge the Releasees from, any and all present and future claims and liability, including negligence, for death, disability, personal injury, property damage, property theft or actions of any kind arising from and which are in any way connected with my participation in this event, related activities, and/or my traveling to and from this event; B) I indemnify and hold harmless the Releasees from any and all liabilities or claims made by other individuals or entities as a result of
my or any actions during this event. I hereby consent to receive medical treatment, which may be
deemed advisable in the event of injury, accident and/or illness during this event. I understand that the
activities that I am participating in may be conducted at sites that are remote from available medical
assistance and nonetheless agree to proceed with such participation in spite of the possible absence of
medical assistance. I am aware that this event is not an event permitted by USA Cycling and that USA
Cycling insurance does not apply. I understand that at this event or related activities I may be
photographed. I agree to allow my photo, video or film likeness to be used for any legitimate purpose by
the event holders, producers, sponsors, organizers and/or their assigns. If I am signing this form as
guardian for a minor, I take all of the above actions on behalf of such minor and understand that the
terms shall likewise bind me, my heirs, legal representatives and assigns. This City of Fort Dodge
Accident Waiver and Release of Liability shall be construed broadly to provide a release and waiver to
the maximum extent permissible under applicable law. I hereby certify that I have read this document
and I understand its contents. I fully understand that by signing this form, I am giving up legal rights
and/or remedies that may be available to me.
PARTICIPANT ACCEPTANCE I have read the entire document carefully and understand its terms, Including the substantial legal rights that I am giving up. This acknowledgement covers all events sponsored by these organizations as listed by the above dates. Helmet required for each event.

PARENT/LEGAL GUARDIAN CONSENT, REPRESENTATIONS AND AGREEMENTS (INCLUDING
INDEMNIFICATION AND LIABILITY WAIVER & RELEASE) I am the parent or legal guardian of the Participant named above and I am 18 years of age or older. I represent and agree that: (1) I have the legal right to enter into the above Agreement on behalf of the Participant; (2) I hereby consent to and agree to, on Participant’s behalf, all of the above terms and conditions in the above Agreement; (3) I agree, under the same terms as those described above for the Participant, to HOLD HARMLESS, DEFEND AND INDEMNIFY the Released Parties from any and all claims of mine, as well as claims of my spouse, heirs, representatives or assigns, arising or allegedly arising from loss or damage (be it personal injury, property damage, or any other type of loss or damage) due the Participant’s attendance at or participation in any of the Events described above; and (4) I hereby WAIVE, RELEASE and DISCHARGE any and all future claims that I may have, related the Participant’s attendance at or participation in the Events, for harm alleged to have been caused by a Released Party, under the same terms as those described above for the Participant. I have read the entire document carefully and understand its terms, including the substantial legal rights that I am giving up.
